Former Alabama Republican Congressional Candidate and Huntsville Lawyer Facing Nine Counts of Deceit & Fraud

Cheryl Baswell Guthrie was arrested September 1, 2011 at a Detroit airport "as a fugitive from justice" and held in a Wayne County, Michigan jail until she was transferred to Madison County, Alabama on September 19th.

She made bond the following day and was released pending a hearing on October 12.

The 'story' gets curious from there. According to a Huntsville Times article that ran on September 22nd, Baswell Guthrie is accused of a $50,000 dollar first-degree theft of property involving a "victim from Sheffield."

We found something very different when we looked into court filings that might better explain the presence of the Securities & Exchange Commission in the Baswell Guthrie saga. The publicized charge pales in comparison to what she is accused of in the document below.

Interestingly, the nine-count complaint details theft, deceit, wantonness, misrepresentation and repeated misappropriations of large sums of money during the time that Baswell Gunther was running for the AL-5th Congressional seat. Is this where the large sums of money came from that Baswell Guthrie personally funded the majority of her campaign with?

Baswell Guthrie is described through records in opencongress.org as "the Director of nearly a dozen profit and non-profit corporations." We hope the records of those organizations are being closely scrutinized and no taxpayer funds are involved in any questionable financial behavior.

These accusations are quite serious, Sheffield residents are not the plaintiffs, Baswell Guthrie is a known flight risk, and the court decided to let her out on a paltry $5,000 dollar bond?

September's news reports are based on an additional, separate charge against Baswell Guthrie from a 2008 theft that wasn't filed on until August 26, 2011. Her past history and other pending legal actions should be relevant in the current media accounts.

Why aren't we hearing the rest of the story?

  1. What the hell is going on with the media? Are they all sitting around and cooking up junk stories to deflect from the real story? This woman deserves to be exposed for what she is and once again your team is right on point.

    Guthrie has contributed more than $600,000 of her own money to her campaign. She said she made the decision up front not to take contributions from political action committees or lobbyists, which she says have become too powerful in Washington.

    "When a candidate uses their own money, it avoids any perception of corruption," Guthrie said during an interview Thursday at her law office. "When you accept money from groups, there’s a perception that now you are going to owe those people, that promises have been made."

    Status: FAIL

  5. I have NO SYMPATHY for her.
    Her family is another matter.
    When people do things like this it reveals the fatal flaw in their character that hurts everyone close to them; narcissism.
    What about her husband and son? How embarrassing this has to be for them.

  6. Flag on the field--lawyers like this don't go through their careers without a long history of complaints.

    The Alabama State Bar is refusing to comment about any current or previous Letters of Complaint regarding Mrs. Baswell-Guthrie.

    That's a safe (and cowardly) stance for them to adhere to given the fact that they have a lot of information on her.

    If the ASB continues this beaten down path of stubbornly refusing to expunge the systemic corruption and bad apples from their ranks people will continue to fall victim to these types of charlatans.

    The public has a right to know and should have access to records and letters contained in the ASB. It's past time for reform in this organization.

  7. It took me about 2 minutes to find this;
    "According to sources "she convinced a person to donate to her campaign based on backing from national republicans, got a big loan, in part based on the promise to repay with security using a building as the collateral. She then transferred the building to another corporation and left the donor high and dry - never paid it back. Something to the tune of 400K. Check Madison County court filings - think there is a civil suit"
    Who else is dirty in this deal and is that the reason for the underreporting? Something really stinks about the media jabber.

  9. Every day it's something else in Alabama---this official indicted, that one charged with theft, another one violating ethics and most of them, unless they're democrats or republican red-headed stepchildren, get away with it (insert hand slap sound here)---anybody seeing a pattern?

  11. The case was originally filed in March of 2009. This makes me wonder just what hoops did these people have to jump through in order to get some action. You can bet the resistance was fierce.

    If this is what folks have to go through in order to get a case to court, a 28 month wait, what does that tell you?

    This is ridiculous and I for one will not be surprised if this one skates on the charges, a deal can be brokered, shush up the Plaintiffs and no one will be the wiser.

    Most politicians can't resist the temptation(s) surrounding them once elected. It is a sad day in this country.

  14. The cases filed were cv-2009-9000924 and cv-2009-900925 and
    cv-2009-900926. You may need to put 47 in front of these numbers. All cases have been consolidated into 47-cv-2009-900926.00.

    Pay specific attention to a lawsuit filed on 8/20/2009 at 4:40 pm in cv-2009-900926.00. This was filed in madison county so would probably be on alacourt not pacer.

    Parties are Jeri Holden, David Pape, Huntsville American Cabinets, Inc, and Colinwood development group Inc.,
